Introduction

This coaching agreement between "you" (The Client) and "the coach" (Ciaran Barry; Ciaran Barry Coaching) will set out the ground rules for the coaching relationship and clarify expectations. Our Terms of Service govern the use of our services and are intended to ensure a clear understanding of the mutual obligations between Ciaran Barry Coaching and you.

Nature of Service

Ciaran Barry Coaching offers life and career coaching services, which includes the LIMITLESS LIFE™ PROGRAMME; the CAREER LAUNCHPAD PROGRAMME, INDIVIDUAL COACHING SESSIONS, MASTERCLASSES and WEBINARS. It is important to note that our services are not a substitute for professional mental health care or medical care.

Description of Coaching

Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximise personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals. In undertaking to meet with you, I am committing myself to meeting you on the dates and time(s) we have agreed upon. I will endeavour to create a safe and confidential learning environment so that you develop your self-awareness and take responsibility for managing your learning. In undertaking to see me for coaching you are committing yourself to seeing me regularly at the agreed times. For our coaching relationship to work well it will be important for you to come to your coaching sessions prepared to explore and analyse the aspects of your life that you want to change. In coaching we will look at those things that interfere with your progress and stop you reaching your full potential. In particular we will explore those attitudes, behaviours, values and beliefs that hold you back and stop you from doing the things you want to do.

Client Obligations

You are expected to:

• Be committed to the coaching process.
• Provide accurate and honest information.
• Be ready to manage the negative thoughts and feelings, attitudes, behaviours and actions that hold you back.
• Be prepared to try out new ideas or ways of doing things and reflect and learn from the experience.
• Be prepared to listen to feedback and act on it where appropriate to do so.
• Be prepared to spend time in between sessions working through any action points you set.
• Respect the confidentiality and intellectual property rights of Ciaran Barry Coaching.

Confidentiality

We hold our clients' privacy in the highest regard. Accordingly, all personal information provided by the Client will be treated with the utmost confidentiality and will not be disclosed except as mandated by applicable law or as explicitly consented to in writing by the Client. While our coaching services are conducted under a principle of confidentiality, it is important for the Client to understand that the Coach-Client relationship does not fall under a legally confidential relationship, such as those recognised in medical or legal professions. Therefore, communications within this relationship are not protected by any legally recognised privilege. Notwithstanding the foregoing, the Coach commits to not divulge any information pertaining to the Client without obtaining the Client's express written consent, in compliance with the General Data Protection Regulation (GDPR) of the European Union. Limited Liability

Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages such as financial loss. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date. Results from coaching are not guaranteed. Ciaran Barry Coaching is not liable for any decisions taken by the client as a result of the coaching.

Release of Information

The Coach is committed to ongoing professional development, including the pursuit and/or maintenance of credentials from the International Coach Federation (ICF). As part of this process, the ICF requires the submission of client names and contact details for potential verification purposes. By agreeing to these Terms of Service, the Client consents to the disclosure of their name, contact information, and the start and end dates of their coaching engagement to ICF staff members and/or any other parties involved solely for the purpose of verifying the coaching relationship. It is expressly understood that no personal notes or confidential information pertaining to the coaching sessions will be shared as part of this process

Records

Throughout the duration of the coaching sessions, the Coach will maintain records, which may include the Client's agenda, meeting notes, and any action points agreed upon. These records will be securely stored for the duration of the Client's engagement with Ciaran Barry Coaching and retained for a period of twelve (12) months following the termination of the contract. After the lapse of this twelve-month period, all such records pertaining to the Client will be permanently deleted, unless the Client requests in writing prior to the expiration of this period that these records be provided to them. The handling and storage of these records will be conducted in compliance with applicable data protection laws and regulations.

Payment Terms

The fees applicable for the services provided by Ciaran Barry Coaching are outlined in our portfolio, accessible at www.ciaranbarrycoaching.com/coaching. Payment for the selected service must be received in full prior to the commencement of the service. In the event of a delay in payment, we reserve the right to postpone the provision of the service until such time as the payment is made in full. This condition is in place to ensure a clear understanding and agreement regarding the financial terms associated with the services offered.

Cancellation and Rescheduling Policy

The Client has the right to cancel or reschedule any appointment by providing Ciaran Barry Coaching with a minimum notice of twenty-four (24) hours prior to the scheduled appointment time. In the event that such notice is not provided within the specified timeframe, the Client may be subject to a cancellation fee. Additionally, consistent failure to provide timely notice may result in the restriction of the Client's ability to book future appointments. This policy is instituted to ensure the effective and efficient management of the Coach's scheduling commitments.

Termination and Refund Policy

The Client has the right to terminate the coaching programme at any point during its term. Should the Client wish to terminate the Agreement prior to the expiration of the agreed-upon term, they must provide a minimum of fourteen (14) days' written notice to Ciaran Barry Coaching. It is expressly understood and agreed that in the event of such termination by the Client, no refunds of any fees or other payments will be made under any circumstances.

Intellectual Property

All materials provided during coaching sessions and on our website www.ciaranbarrycoaching.com are the property of Ciaran Barry Coaching and cannot be used or reproduced without prior written consent.

Governing Law

These Terms of Service are governed by the laws of the Republic of Ireland and the European Union.

Acceptance of Terms

By accessing and using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Amendment Clause

Ciaran Barry Coaching reserves the right to amend these Terms of Service at any time. All amendments will be posted on our website.
